Agreement to Terms

By downloading, installing, accessing, or using Hush: Better Sleep Sounds (“Hush”, “the App”, “we”, “us”, or “our”), you agree to these Terms of Service. If you do not agree, do not use the app.

License and Apple Terms

Hush is licensed, not sold, to you. Your use of the app is subject to these Terms and, where applicable, Apple’s App Store rules and Apple’s Standard Licensed Application End User License Agreement unless a custom agreement is provided.

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to use Hush on Apple-branded devices that you own or control, subject to applicable App Store usage rules.

Subscriptions and In-App Purchases

Hush may offer auto-renewable subscriptions and other in-app purchases through the App Store.

• Payment will be charged to your Apple Account at confirmation of purchase
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current billing period
• Your Apple Account may be charged for renewal within 24 hours before the end of the current period
• You can manage subscriptions and turn off auto-renewal in your Apple Account settings after purchase
• Any free trial, if offered, may convert to a paid subscription unless cancelled before the trial ends

Pricing, billing, refunds where applicable, and payment processing are handled through Apple and are also subject to Apple’s terms and policies.

Use of the App

You agree to use Hush only for lawful purposes and in compliance with applicable law and App Store rules.

You may not:

• Copy, redistribute, sublicense, rent, or lease the app except as permitted by law
• Reverse engineer, decompile, or disassemble the app except where such restriction is prohibited by law
• Interfere with the operation, security, or integrity of the app
• Use the app in a way that violates the rights of others

Availability and Updates

We may modify, update, suspend, or discontinue all or part of Hush at any time. Features, content, subscription offerings, and availability may change without notice.

We may also release updates to improve performance, compatibility, or functionality. Some updates may be required for continued use of parts of the app.

Health and Wellness Disclaimer

Hush is intended for general wellness, relaxation, and entertainment purposes only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, condition, or sleep disorder.

If you have medical concerns, sleep disorders, or questions about your health, seek advice from a qualified healthcare professional.

Intellectual Property

Hush, including its software, audio assets, branding, design, and related content, is owned by or licensed to us and protected by applicable intellectual property laws. These Terms do not transfer ownership to you.

Disclaimer of Warranties

Hush is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, or goodwill arising from your use of or inability to use Hush.

Where liability cannot be excluded, our total liability will be limited to the amount you paid for the app or subscription giving rise to the claim, if any.

Termination

These Terms remain in effect until terminated by you or us. We may suspend or terminate your access to the app if you violate these Terms. Upon termination, the rights granted to you under these Terms end immediately.

Privacy

Your use of Hush is also governed by our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date on this page. Continued use of the app after changes become effective means you accept the revised Terms.
